1. Acceptance of Terms

By engaging ProProfile, purchasing our deployment packages, or using this website, you agree to be bound by these Terms of Service. If you are entering into these terms on behalf of a clinic, medical spa, or business entity, you represent that you have the authority to bind that entity.

2. Services Provided: The Clinic Growth Engine

ProProfile provides specialized technical implementation and managed infrastructure for aesthetic medical clinics and medical spas. The flagship offering (the "Clinic Growth Engine") encompasses:

Autonomous AI Voice & Text Reception: Custom conversational AI agents configured to answer inbound phone calls, respond to missed-call SMS inquiries, qualify caller intent, and provide treatment menu information.
CRM & Calendar Synchronization: Technical routing to push appointment bookings, call audio recordings, and interaction transcripts directly into the client's existing CRM calendar. Data flows one way into the client CRM.
High-Speed Web Architecture: Conversion-engineered landing page architecture designed for mobile performance and rapid consultation scheduling.

3. Commercial Terms & Deployment Scope

Setup & Monthly Fees: ProProfile provides the 6PM Shield Growth tier at $697 per month with 1,000 minutes included ($0.45 per minute overage). The $2,500 one-time buildout (custom treatment scripts, voice training on your menu, CRM/calendar integration, 14-day deployment) is waived for Founding 10 members as specified in the service agreement.
Deployment Timeline: Technical implementation is completed within 14 days from contract execution and onboarding asset delivery.

4. 60-Day Performance Guarantee

ProProfile backs the 6PM Shield with a clear performance guarantee: 30 booked consultations in 60 days or month 3 free. If the system does not deliver 30 booked consultations within your first 60 days, your third month of service fee is waived.

5. Clinical & Operational Guardrails

Non-Clinical Scope: ProProfile AI voice and messaging agents are administrative booking tools. The AI handles FAQs, clinic logistics, and appointment scheduling. It never diagnoses medical conditions, provides treatment advice, or alters patient medical charts.
Call Recording Notice: Calls handled by the AI announce that they are recorded to maintain full compliance with Florida two-party consent laws and applicable telephony regulations.

6. Client Responsibilities & Acceptable Use

Clients are responsible for maintaining accurate treatment pricing, provider availability, and licensing compliance. Clients agree not to use ProProfile systems for unlawful communications, unauthorized mass messaging, or abusive activities.

7. Limitation of Liability

In no event shall ProProfile be liable for indirect, incidental, or consequential damages arising from telecom carrier outages, third-party CRM API disruptions, or calendar scheduling errors beyond ProProfile's reasonable technical control.

8. Governing Law & Jurisdiction

These terms and any disputes arising out of or related to our services shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any legal action or proceeding shall be brought exclusively in the state or federal courts located in the State of Florida.
